A pergola is an outdoor structure offering shade or a decorative framework, but it may have permit requirements and unclear maintenance responsibilities.

This is the landlord's responsibility, but an illegally built structure can cause problems down the line, especially if the municipality orders it to be removed. Furthermore, if the property is part of a Homeowners' Association (VvE), the VvE must have granted permission for its construction, as it affects the external appearance of the building. A savvy tenant might politely inquire if all the necessary permits and permissions are in place.\nThe Maintenance Grey Area\nWho is responsible for maintaining the pergola? This is a classic rental contract grey area. Is staining or painting the wooden structure to protect it from the Dutch rain considered minor, cosmetic work (klein onderhoud) for the tenant, or is it major structural upkeep (groot onderhoud) for the landlord? What about pruning the wisteria or grapevines that are often trained to grow over it? The official government list of tenant responsibilities doesn't mention pergolas specifically. This means it must be explicitly defined in the rental agreement. If it isn't, the default assumption is that major upkeep falls to the landlord, but this can easily lead to a dispute. A tenant who loves the feature should be prepared for the possibility that the landlord may neglect its upkeep, leaving them with a rotting, unsightly structure.
