Assigned parking (vaste or toegewezen parkeerplaats) is a guarantee of a specific, numbered parking space for the exclusive use of a resident. This is a crucial amenity in urban areas where parking is scarce. Unlike 'scramble' parking where residents of a building compete for a limited number of unmarked spots, an assigned space ensures that the tenant always has a place to park. This right is typically formalized in the rental agreement or, more commonly, in a separate lease agreement specifically for the parking space. In modern apartment complexes, this will be a numbered spot in the building's shared garage. In some older developments, it might be a designated space in an outdoor, private parking lot.
While having an assigned spot provides legal security, it does not always guarantee practical availability. The most common and infuriating problem is finding another vehicle—belonging to a visitor, a delivery person, or another resident—occupying your reserved space. This is where the system often breaks down. The responsibility for enforcement is a major grey area. Is it the landlord's job to police the parking? Or the building manager's? Or the Owners' Association's (VvE)? In reality, these bodies are often slow to act or declare that it is a civil matter between the two car owners. The process for having an unauthorized vehicle towed in the Netherlands is slow, bureaucratic, and not something an individual can easily initiate. This can leave the tenant with a legally assigned spot that is practically useless when they need it most. A skeptical tenant should inquire about the building's policy and procedure for dealing with parking violations before signing the lease, as a right without a remedy is no right at all.
