The lease duration, or huurtermijn, specifies the period for which the rental agreement is made. In the Netherlands, this is not just a simple date on a calendar; it is the single most important clause that defines the nature of the entire agreement and dictates the balance of power between you and the landlord. There are two primary categories of lease duration for residential properties, and understanding the profound difference between them is essential for any tenant.
Contract voor Onbepaalde Tijd)This is the traditional and most secure form of rental agreement. An indefinite contract has a start date but no end date. By signing this type of lease, a tenant acquires extensive rent protection (huurbescherming). This means you have the right to remain in the property for as long as you wish, provided you fulfill your obligations (like paying rent). A landlord cannot simply evict you. To terminate an indefinite contract, a landlord must have one of a very limited number of legal grounds (e.g., they need the property for their own urgent use, or the tenant is causing a severe nuisance), and they must get permission from a court to do so. This provides immense long-term housing security.
Tijdelijk Huurcontract)Introduced to add flexibility to the market, temporary contracts have a specific end date. For a self-contained property, the maximum duration is two years. For a single room, the maximum is five years.
