An apartment lease, or huurovereenkomst voor een appartement, is the cornerstone of the Dutch urban rental market. It is a legally binding contract for a self-contained residential unit (zelfstandige woonruimte) within a larger building. This is the most common form of rental agreement tenants will encounter. The contract itself is a standard huurovereenkomst voor woonruimte, which is heavily regulated by the Dutch Civil Code. This body of law provides tenants with extensive rights and protections, collectively known as huurbescherming (tenant protection). This protection is one of the strongest in Europe and is the defining feature of Dutch residential rental law.
Every apartment lease in the Netherlands falls into one of two categories, determined by the basic rent price at the start of the contract. 1. Social Sector (Sociale Huur): If the initial rent is below a specific government-set threshold (the liberalisatiegrens), the property is in the regulated social sector. Here, the maximum rent is determined by a points system (woningwaarderingsstelsel), annual rent increases are strictly capped by the government, and tenants can turn to the Huurcommissie (Rent Tribunal) to resolve disputes. 2. Free Sector (Vrije Sector): If the initial rent is above the liberalization threshold, the property is in the free sector. In this segment, the landlord is free to set the initial rent at any price, there is no maximum rent based on a points system, and rent increases are governed by the terms of the lease agreement (though there are some recent legislative caps). Most apartments available to expats and those on the open market fall into the free sector. Understanding which sector your lease falls into is crucial for knowing your rights regarding rent price and increases.
