The definitieve oplevering (final acceptance or delivery) marks the official conclusion of a construction project. It takes place at the end of the maintenance period that was initiated by the voorlopige oplevering (provisional acceptance). This final handover is essentially a verification step: the client and contractor conduct a final inspection with the original list of defects in hand to confirm that the contractor has satisfactorily resolved every single point. Once the client is convinced that all obligations have been met, they formally sign off on the final acceptance.
This is a critical moment that largely absolves the contractor of further responsibility for any defects that were visible or could have been discovered at that time. It typically triggers the release of the final payment or the return of a financial guarantee that the client had retained. However, this does not mean the contractor is entirely off the hook forever. Their liability for verborgen gebreken (hidden defects)—serious flaws that were not discoverable even with a thorough inspection, such as a fundamental structural error—continues for a period defined by law, which can be many years. Nevertheless, proving that a defect was truly 'hidden' can be a difficult and expensive legal battle, making the final inspection before signing the definitieve oplevering one of the most important moments for a property owner.
