Renting From a Renter\n\n### The Legality Minefield\nSubletting, or onderhuur, is extremely common in the Netherlands, but its legal status is often precarious. The starting point is the main rental agreement between the property owner (the head-landlord) and the main tenant. The vast majority of these contracts contain a clause that explicitly forbids subletting without the landlord's prior written permission. If a tenant sublets in violation of this clause, they are in breach of contract, and the landlord can start eviction proceedings against them. The sub-tenant, in turn, can find themselves with no legal right to stay in the property. Many sub-leases in high-pressure housing markets like Amsterdam are therefore illegal and highly risky for the sub-tenant (onderhuurder).\n

The Surprising Protection for Sub-tenants\nDespite the risks, Dutch law offers a surprising and powerful protection in one specific scenario. If the sub-lease is for a self-contained unit (zelfstandige woonruimte, meaning it has its own front door, kitchen, and bathroom) and the main tenant vacates, the sub-lease is automatically continued by the head-landlord. The sub-tenant effectively becomes the new main tenant, with full tenant protection, even if the head-landlord never gave permission for the sublet. The head-landlord can only terminate this new arrangement under a very limited set of grounds and must go to court to do so. This protection, however, does not apply to the subletting of individual rooms (onzelfstandige woonruimte). If the main tenant of a shared flat leaves, the sub-tenants of the individual rooms have no right to stay.\n

Practical Risks and Considerations\nFor a prospective sub-tenant, the most critical question is: 'Does the head-landlord know about and approve of this arrangement in writing?' If the answer is no, you are entering a legally fragile situation. You might be paying rent to someone who could be evicted at any moment, taking your housing security with them. You should be extremely skeptical of any informal, cash-in-hand arrangements. Always insist on a written sublease agreement, and try to get confirmation that the primary landlord has consented.
