Property insurance, known in the Netherlands as opstalverzekering, is a type of insurance that covers damage to the physical structure of the building—the 'immovable' property (opstal). This includes the foundation, roof, walls, windows, and fixed installations like the kitchen and bathroom. It provides financial protection against perils such as fire, storm, lightning, and water damage from burst pipes. It is absolutely essential for every tenant to understand that this insurance is the sole responsibility of the property owner (the landlord). If the property is an apartment, the building insurance is typically arranged collectively by the Vereniging van Eigenaars (VvE) and paid for out of the owners' VvE contributions.
A tenant never pays for the opstalverzekering. The premium for this policy is a fundamental cost of owning property, just like property tax or mortgage payments. The landlord is legally and financially responsible for ensuring the building is adequately insured. A landlord is not allowed to pass this cost on to the tenant as a separate fee or as part of the servicekosten. It is an operational cost that is considered to be covered by the basic rent (kale huur) the landlord receives. Any attempt by a landlord to charge a tenant for 'property insurance' is illegal.
The opstalverzekering only covers the building itself. It does not cover any of the tenant's personal belongings inside the apartment. This is where the crucial distinction lies. The tenant is responsible for insuring their own possessions by taking out a separate contents insurance (inboedelverzekering) policy. If a fire damages the building's structure, the landlord's insurance will pay to fix the walls and roof. But if that same fire destroys your sofa, your television, and your clothes, you can only get compensation if you have your own contents insurance. Understanding this division of responsibility is one of the most important aspects of being a financially protected tenant.
