The question of who pays for pest control (ongediertebestrijding) is a classic landlord-tenant issue, and the answer depends entirely on the cause and nature of the infestation. Tenant's Responsibility: The tenant is generally responsible for the costs if the pests are present due to their own actions or negligence. For example, an infestation of mice or cockroaches attracted by improper food storage or poor hygiene is the tenant's financial problem to solve. The tenant is also typically responsible for dealing with common, minor pests that do not result from a structural issue, such as ants, silverfish (zilvervisjes), or fleas brought in by a pet. Landlord's Responsibility: The landlord is responsible for the cost if the pest problem is a result of a structural defect (bouwkundig gebrek) in the property. For example, if mice are getting in through holes in the foundation or walls, the landlord must seal the holes and pay for the extermination. The landlord is also always responsible for pests that affect the structure of the building itself, such as woodworm (houtworm) or termites.
In some large apartment buildings, the landlord or VvE may have a preventative maintenance contract with a professional pest control company. This company might perform regular inspections of communal areas and lay traps as a proactive measure. The costs for such a preventative service contract can be legitimately included in the building's overall service costs (servicekosten). In this case, all tenants contribute a small amount via their monthly advance payment (voorschot) to prevent large-scale infestations from occurring. This is a legitimate charge, provided it is transparently accounted for in the annual final settlement (eindafrekening).
If you discover pests in your home, and you do not believe it is your fault, you must inform your landlord immediately in writing. This is crucial for establishing the landlord's responsibility. Provide specific details and photos if possible. A landlord who fails to act on a pest problem caused by a structural defect is neglecting their maintenance duty. A quick response is essential, as infestations can spread rapidly to neighboring apartments, turning a small problem into a major building-wide issue.
