A parking space lease is a rental agreement for the exclusive use of a designated parking spot (parkeerplaats). This can be a space in an open-air car park, a numbered spot in a residential parking garage, or on the street under a permit system. In many modern apartment complexes, a parking space is offered alongside an apartment, but it is often—and critically—covered by a separate lease agreement. This legal separation is deliberate and has significant consequences for the tenant. While the apartment lease is heavily regulated and provides strong tenant protection, the parking lease is not considered a residential dwelling. Therefore, it falls under the same unprotected legal category as a warehouse or storage unit ('other business space', Art. 7:230a BW). This means the landlord has near-total freedom to set the terms of the agreement.
The most important thing for a tenant to understand is that their rights to the parking space are completely detached from their rights to their home. The landlord can set any price for the parking spot and can increase it at any time, unless the contract explicitly contains a clause limiting rent hikes. There is no points system or Rent Tribunal to appeal to. More critically, the termination rules are different. While a landlord needs a strong legal reason to terminate a residential lease, they can often terminate a parking lease with just one or two months' notice, as stipulated in the contract. This can lead to a situation where a tenant still has the right to their apartment but suddenly loses their parking space, which may have been a key reason for choosing the property in the first place. Tenants should be highly skeptical of verbal assurances that the parking spot 'comes with the apartment'. The reality is defined by the written contract, and in most cases, that contract will treat the parking space as a separate, unprotected commercial asset, giving the tenant minimal security.
