This decree sets out the minimum legal requirements that all buildings in the Netherlands—new and existing—must meet. It is the primary reference for determining if a property is fundamentally safe, healthy, and usable.
A landlord has a legal duty to provide a property that complies with these standards. If a property fails to meet the minimum requirements of the Bouwbesluit, it automatically has a legal 'defect' (gebrek), which gives the tenant the right to demand repairs and seek remedies like rent reduction.

Veiligheid): This includes structural safety of floors and walls, fire safety (e.g., mandatory smoke detectors on each floor since July 2022, safe escape routes), and the safety of gas and electrical installations.Gezondheid): This covers mandatory ventilation capacity in bathrooms, kitchens, and toilets to prevent mold. It also sets standards for access to daylight in primary living spaces and requires a connection to a functioning sewer system.Bruikbaarheid): This defines the basic functional requirements of a home, such as minimum ceiling heights and the presence of essential facilities like a kitchen and bathroom.A property that lacks a legally required smoke detector, has insufficient ventilation causing persistent mold, or has faulty wiring is not just 'in poor condition'—it is in breach of national law.
While the Bouwbesluit provides a technical baseline, the rental law concept of a 'defect' is even broader. A property could theoretically meet every technical standard in the decree but still be considered 'uninhabitable' in the eyes of rental law. This is because the law focuses on the tenant's 'quiet enjoyment' (huurgenot).
For example, a severe, unresolved pest infestation (e.g., rats or cockroaches) or extreme noise nuisance from a neighboring property also owned by the landlord would be considered a serious defect, even if the building itself is structurally sound. Therefore, habitability standards are a combination of the hard technical rules of the Bouwbesluit and the broader principles of peaceful living defined in rental law.
