A fixed-term lease is a rental contract for a specific, predetermined period, typically 24 months or less.
A fixed-term lease, known in Dutch as a huurcontract voor bepaalde tijd, is now the standard type of agreement for new tenants in the Netherlands' free-sector rental market. It is a contract with a clearly defined start and end date, most commonly set for 12 or 24 months. While it provides clarity on the duration, it creates a dynamic of limited flexibility for the tenant and greater power for the landlord at the end of the term.
Prior to 2016, most leases were indefinite, granting tenants immense protection. The introduction of fixed-term contracts was designed to encourage landlords to rent out their properties by offering them a clear exit strategy. With a fixed-term lease of two years or less, the landlord has the right to reclaim their property at the end of the term without having to provide a legal reason or go to court. They simply have to provide the tenant with proper written notice. This flexibility is highly attractive to landlords who may want to sell the property or use it themselves in the future. For the tenant, this means less long-term security; you have no guarantee you can stay beyond the agreed-upon date.
The most significant consequence for a tenant signing a fixed-term lease is the lock-in period. You are legally obligated to pay rent for the entire duration of the contract. If you sign a 24-month lease, you are on the hook for 24 months of rent, regardless of whether your job moves, your relationship status changes, or you simply find a better apartment. You cannot terminate the lease early unless the contract contains a specific break clause (like a diplomatic clause), or you negotiate a release with your landlord.
However, there is a powerful piece of protection for tenants: the automatic conversion rule. For the lease to end on the agreed date, the landlord is legally obligated to send you a formal written notification. This notice must arrive no earlier than three months and no later than one month before the contract's end date. If the landlord fails this administrative task—by sending the notice too late, too early, or not at all—the fixed-term lease automatically converts into a full-blown indefinite-term lease the day after it was meant to expire. At that moment, you gain maximum tenant protection, and the landlord can no longer simply ask you to leave.
At the end of a fixed-term lease, one of two things happens: either you move out (after receiving proper notice), or the lease converts to an indefinite one. A landlord is legally forbidden from offering you a second fixed-term contract for the same property. Any form of extension or renewal, even if it's called a 'new' fixed-term contract, automatically and legally creates an indefinite lease. This prevents landlords from keeping tenants in a permanent state of temporary insecurity.
