The Owner vs. The User

The rioolheffing, or sewerage levy, is a municipal tax (gemeentelijke heffing) that every household and property owner must pay to cover the costs of maintaining the local sewer system and managing wastewater. It is a crucial, if unglamorous, part of public infrastructure funding. For renters, the most important aspect of the rioolheffing is that it is split into two distinct parts: an owner's portion (eigenarendeel) and a user's portion (gebruikersdeel). This distinction is enshrined in law and is non-negotiable. The owner's portion is a tax levied on the owner of the property, and it is therefore always the landlord's responsibility to pay it. The user's portion is a tax on the person or household actually living in and using the property, making it the tenant's responsibility.

A landlord is legally prohibited from passing on the cost of the owner's portion of the tax to the tenant, either directly or by hiding it within the service costs. This tax is a cost of property ownership, period. The user's portion, however, will be billed directly to the tenant by the municipal tax authority (gemeentelijke belastingdienst) once the tenant has registered their address with the municipality (gemeente). This bill is in the tenant's name and must be paid by the tenant. The amount is often determined by whether you are a single-person or multi-person household.

How to Spot Incorrect Charges

While the legal distinction is clear, less reputable landlords may sometimes try to blur the lines. A tenant should be highly skeptical of any mention of rioolheffing in their service cost breakdown (eindafrekening). Service costs are for the supply of services and utilities, not for the landlord's property taxes. If a landlord includes a charge for 'sewerage levy' in the service costs, it is almost certainly an unlawful attempt to pass on the eigenarendeel to the tenant. The user's part is never paid via the landlord; it is always a direct transaction between the tenant and the municipality. Therefore, any charge for rioolheffing from your landlord should be immediately questioned and challenged. It represents a fundamental misunderstanding, or a deliberate misapplication, of tax law. The same principle applies to other property-specific taxes like the property tax (onroerendezaakbelasting - OZB), which is also strictly the owner's responsibility.
