If a tenant loses the keys to their rental property, they are generally responsible for the costs associated with replacing them. This is a fair and logical principle, as the responsibility for keeping the keys safe lies with the tenant. The landlord is entitled to charge a key replacement fee to cover the expenses incurred. This is not considered an illegal charge, provided the fee is reasonable and directly related to the actual costs. A tenant who loses their keys should report it to the landlord or property manager immediately, not only to arrange a replacement but also for important security reasons.
This is the critical point for tenants. A landlord or agency is not allowed to charge an arbitrary penalty fee for lost keys. The fee must reflect the actual, demonstrable costs of the replacement. The cost can vary significantly depending on the type of key. Standard Key: Replacing a simple, standard key is inexpensive; the cost is just a few euros for cutting a new key. Certified Security Key (Gecertificeerde sleutel): These keys are protected against unauthorized duplication and can only be ordered from the manufacturer with a special certificate. Replacing one is more expensive, potentially costing €30 to €50 or more. Electronic Fob (Druppel or Tag): The cost of a new electronic fob is the price of the fob itself plus any minor administrative cost for programming it. The landlord must be transparent about these costs and, if requested, should be able to provide an invoice. Any fee that is significantly higher than the actual replacement cost can be challenged by the tenant as an 'unreasonable fee'.
The cost of replacing the key itself can sometimes be the smallest part of the problem. The real issue is security. If a tenant loses a key that provides access to a communal entrance of an apartment building, the security of all residents is compromised. In this situation, the Vereniging van Eigenaars (VvE) may decide that the central lock cylinder for the entire building needs to be replaced to ensure no unauthorized person can gain entry. The cost of replacing the lock and providing new keys to every single resident in the building can amount to thousands of euros. The rental agreement or VvE rules may stipulate that the tenant who lost the key is liable for this entire cost. This is why it is so important to handle keys with extreme care.
