The Bouwbesluit 2012 (Building Decree 2012) is one of the most important pieces of legislation governing the physical state of rental properties in the Netherlands. It is the comprehensive, national rulebook that sets the minimum technical standards for every structure in the country, from skyscrapers to single-family homes. A landlord doesn't get to decide what is 'good enough'; they are legally bound to provide a property that complies with the extensive requirements of the Bouwbesluit. These requirements cover a vast range of topics, including:
Veiligheid): This covers structural integrity (e.g., strength of floors and walls), fire safety (brandveiligheid), and prevention of accidents (e.g., height of railings on balconies).Gezondheid): This includes requirements for ventilation, access to daylight, protection against damp and pests, and safe drinking water installations.Bruikbaarheid): This involves standards for minimum room sizes and ceiling heights, accessibility, and the general layout of the property.Energiezuinigheid): The decree sets minimum standards for thermal insulation and the energy performance of buildings, which is reflected in the mandatory energielabel (energy label).A property that fails to meet these minimum standards is not legally fit for habitation. If a tenant is living in a home with serious structural or safety defects that violate the Bouwbesluit—such as inadequate ventilation causing severe mold, or unsafe electrical wiring—the landlord is in breach of their legal obligations.
Compliance with the Bouwbesluit is not based on an honor system. Enforcement is the responsibility of the municipality (gemeente), specifically its building and housing supervision department (afdeling Bouw- en Woningtoezicht). This department has the authority to inspect properties and take legal action against owners who fail to meet the required standards. If a tenant has a serious complaint about a building code violation and the landlord refuses to act, the tenant can file a formal request for enforcement with the municipality. The municipality will then investigate. If they find the complaint to be valid, they can issue an enforcement order (handhavingsbesluit) compelling the landlord to carry out the necessary repairs by a certain deadline. If the landlord still fails to comply, they can be subjected to hefty fines for each day the violation continues, or the municipality may even carry out the repairs itself and bill the landlord for the costs. This makes the Bouw- en Woningtoezicht a powerful ally for tenants living in substandard or unsafe conditions.
