A tenant break clause is a provision that gives the tenant the right to terminate the lease agreement before its conclusion. The importance of this clause depends entirely on the type of contract you have. 1. Indefinite Contract (Onbepaalde Tijd): In this type of contract, which is the default and most secure form of tenancy, a specific 'tenant break clause' is legally redundant. Your right to terminate the lease at any time is a mandatory legal right (dwingend recht) granted by the Dutch Civil Code. You simply need to provide the correct notice period, which is your payment period (almost always one calendar month). Any clause in the contract that attempts to require a longer notice period from the tenant or to lock them in for a minimum period is legally void. 2. Fixed-Term Contract (Bepaalde Tijd): In a fixed-term contract (e.g., for 12 or 24 months), a tenant break clause is absolutely critical. The default legal position is that such a contract cannot be terminated early by either party. Without an explicit break clause, you are legally obligated to pay rent for the entire term.
When reviewing a fixed-term rental agreement, you must actively search for this clause. It might be called a tussentijds opzegbeding or a break-clausule. A well-worded clause will state something like: "Huurder heeft het recht de huurovereenkomst tussentijds op te zeggen met inachtneming van een opzegtermijn van één kalendermaand."` (The tenant has the right to terminate the rental agreement prematurely, observing a notice period of one calendar month). If this clause is absent, you should be aware that you are committing to the full, unbreakable term. This lack of flexibility can be a significant financial risk if your personal or professional circumstances change unexpectedly.
