Bodemverontreiniging (soil contamination) is a significant issue in the Netherlands, a country with a long history of industrial activity and dense land use. It refers to the presence of harmful chemical substances in the ground, often resulting from historical industrial sites, leaking underground oil tanks from older homes, or the past use of contaminated materials for land filling. When contamination is discovered, it can trigger complex legal obligations and potentially expensive cleanup (sanering) operations. The presence of serious contamination can affect a property's value and its suitability for specific uses, especially residential.

A Renter's Invisible Risk

For a tenant, soil contamination is an invisible risk. A landlord has a legal duty to inform a tenant of any serious contamination that could pose a health risk, particularly in the garden where children might play. Exposure to substances like lead, asbestos, or mineral oils in the soil can be a serious health concern. The Dutch government maintains a public online portal, the Bodemloket, where anyone can check a specific address for registered cases of historical contamination. However, not all polluted sites are registered, and the absence of a record is not a guarantee of clean soil. A tenant is largely dependent on the landlord's legal duty of disclosure and the oversight of the municipality. The issue becomes critical before any major landscaping or excavation work, which could disturb and expose previously stable contaminants.
