It allows the tenant to pay their rent to a neutral third party, such as a court or an escrow account, instead of directly to the landlord. This money is held until the landlord fulfills their maintenance obligations, creating direct financial pressure to perform the repairs. It's a powerful tool designed to ensure funds are available for repairs while protecting the tenant from eviction for non-payment.
However, this specific legal process does not exist in the Netherlands. A Dutch tenant cannot unilaterally decide to pay their rent to a third party or set up their own escrow account. Doing so would be considered a breach of the rental contract and would constitute non-payment of rent, giving the landlord grounds to start eviction proceedings. The Dutch system provides a different, more formal, and arguably more structured path to achieve a similar outcome.
HuurcommissieThe Dutch solution to a landlord's failure to maintain a property is the 'rent reduction due to defects' procedure (huurverlaging wegens gebreken). Instead of withholding the entire rent, a tenant can petition the Huurcommissie (Rental Tribunal) for an official, temporary reduction of their rent. This process is highly regulated:
Huurcommissie.Huurcommissie will assess the severity of the defect, often using a detailed 'defect book' (gebrekenboek) that categorizes issues. Based on the category, they will grant a specific percentage of rent reduction. For a very severe defect (e.g., no functional heating in winter), the rent can be reduced by as much as 80%.This reduced rent is paid directly to the landlord. The reduction remains in force until the landlord proves to the Huurcommissie that the defect has been repaired. This system ensures the landlord still has some cash flow but is heavily penalized for their inaction, creating a strong incentive to make repairs. It replaces the need for an escrow by directly adjusting the tenant's primary obligation.
It cannot be stressed enough that simply stopping rent payments is a perilous path for a tenant in the Netherlands. While it might feel justified when dealing with a serious defect, it puts the tenant in immediate breach of their contract. The only legally sound ways to apply financial pressure are to obtain an official rent reduction ruling from the Huurcommissie or, in very specific circumstances and after legal advice, to have a repair done and deduct the cost from the rent. Unsanctioned rent withholding is a fast track to the courtroom, where the tenant will likely be on the losing side.
