This is called termination by wederzijds goedvinden (mutual consent). If a tenant wants to leave early and the landlord agrees, or vice versa, they can sign a separate termination agreement (beëindigingsovereenkomst) that sets out the terms of the early departure. This is a common and perfectly legal way to end a lease, and it does not require a pre-existing clause in the contract. It relies solely on the current agreement of both parties.
The situation becomes different and legally complex when the original rental contract contains a 'mutual break option' clause that purports to give both the tenant and the landlord the unilateral right to terminate the lease early. While it sounds fair and balanced, in the context of Dutch residential law, it is not. Because of mandatory tenant protection (huurbescherming), such a clause is legally asymmetrical: 1. The Tenant's Option: The tenant's right to use the break clause to terminate the lease will be upheld by a court. 2. The Landlord's Option: The landlord's right to use the same clause will be deemed void if it undermines the statutory grounds for termination. A landlord cannot enforce this clause to evict a tenant who does not wish to leave. Therefore, a 'mutual' break clause in a residential lease effectively functions only as a tenant break clause.
If you and your landlord do agree to terminate the lease early, it is crucial to formalize this agreement correctly to avoid future disputes. Do not rely on a verbal promise. You should both sign a beëindigingsovereenkomst. This document should clearly state the agreed-upon final date of the tenancy, the arrangements for the key handover and final inspection, and the timeline for the return of the security deposit. A properly signed termination agreement is legally binding and provides clarity and protection for both the tenant and the landlord.
