A 'lease assignment agreement' is the legal document used to formalize the process of indeplaatsstelling (lease assignment/substitution). This agreement is a three-party contract between the original tenant, the new incoming tenant, and the landlord. It confirms that the new tenant will take over the original rental agreement under its existing terms and that the original tenant is released from all further liability. As this process is almost exclusively applicable to commercial real estate (shops, offices, etc.), this type of agreement is not something a residential tenant will typically encounter or be able to use.
The concept of a personal, non-transferable relationship is much stronger in residential leases. The only legally secure way to rent a residential property is to sign a formal rental agreement directly with the landlord or their authorized property manager.
