Buyers and sellers in the Netherlands have long relied on voluntary guidelines for realtors (makelaars), but recent findings by homeowners’ association Vereniging Eigen Huis (VEH) reveal that non-binding rules fail to prevent unfair and opaque practices. Between February and July 2026, VEH received an alarming 921 complaints highlighting conflicts of interest, unclear bidding procedures, and undue pressure on prospective buyers. In response, VEH is demanding statutory rules, automatic bid logbooks, and stronger supervision to restore trust in the home purchasing process.
The current framework governing Dutch real estate transactions is based on voluntary codes of conduct. While these guidelines outline best practices—such as independent advice, clear communication, and transparent record-keeping—they lack legal teeth:
Cindy Kremer, director of VEH, warns that these weaknesses erode confidence: "Voluntary guidelines alone cannot guarantee a fair and verifiable process. Buyers and sellers deserve statutory safeguards and proper oversight."
Analysis of the 921 complaints filed via the VEH hotline uncovered recurring problems across the Dutch housing market:
Conflicts of Interest and Preferential Treatment
Buyers and sellers reported that realtors prioritised certain clients—often those offering higher fees or who promised repeat business—undermining the duty of neutrality.
Unclear Bidding Procedures
Several buyers discovered that bids submitted after the official deadline were still accepted, or that an informal “top-secret” bid was excluded from the bidding logbook, leaving participants in the dark.
Pressure to Increase Offers
Realtors allegedly told buyers about inflated competing bids that never appeared in the official records, coercing them into making higher offers for fear of losing the property.
Lack of Verifiable Documentation
Without an automatically generated bidding logbook, buyers have no reliable proof of how many bids were received, their amounts, or the exact sequence in which they arrived.
To address these shortcomings, VEH is calling on the Dutch government and parliamentarians to adopt clear, binding rules covering every step of the home purchase process:
PVV member of parliament Jeremy Mooiman has already drafted a bill aimed at creating a fairer, more verifiable purchasing process. VEH’s findings were submitted to his office for consideration.
A central pillar of VEH’s proposal is the digital bid logbook, modelled on best-practice systems used in other countries. Key benefits include:
Implementing an automated logbook also leverages technology to standardise bidding across the Netherlands’ diverse municipalities (gemeenten), making it easier for newcomers and internationals to understand and trust the process.
Legislation alone is not enough—effective supervision and meaningful penalties are crucial. VEH proposes:
By holding realtors accountable, the market can shift from a reputation-based system to one underpinned by clear legal obligations.
While legal reforms move through parliament, prospective buyers and sellers can take proactive steps:
The Dutch housing market faces ongoing challenges: rising demand, limited supply, and increasing prices. Ensuring that the home bidding process is transparent, fair, and enforceable will bolster trust and help stabilise the market. Legal rules, combined with robust supervision, can protect both buyers and sellers from exploitation.
