Fire safety (brandveiligheid
) in Dutch rental properties is not left to a landlord's discretion. It is strictly governed by national law, primarily the Bouwbesluit 2012
(Building Decree 2012). This decree sets out the minimum technical and structural requirements that all buildings—new and existing—must meet. The landlord is legally responsible for ensuring their property complies with these standards at all times. These regulations are designed to prevent fires from starting, to slow the spread of fire and smoke if one does occur, and to ensure that all occupants can evacuate the building safely.
Key aspects of brandveiligheid
include the use of fire-resistant materials in construction, requirements for fire extinguishers in common areas of apartment complexes, and rules for the safe installation of heating and electrical systems. A tenant who has serious concerns about the fire safety of their dwelling—for instance, due to exposed or faulty wiring, or a lack of proper fire separation from an adjacent property—has the right to demand that the landlord rectify the situation. If the landlord fails to act, the tenant can report them to the municipal building inspectorate (Bouw- en Woningtoezicht
).
A critical component of fire safety is the vluchtroute
, or escape route. The Bouwbesluit
dictates that from any point within a dwelling, it must be possible to reach a safe, open area (i.e., the outside) via a clear path. This means that corridors, hallways, and stairwells that form part of an escape route must never be blocked. A landlord cannot store furniture in a shared hallway, nor can a tenant obstruct it with bicycles or personal belongings. Doors on escape routes must be easy to open from the inside without a key.
Since July 1, 2022, the rookmelderplicht
(smoke alarm obligation) has been a vital addition to these safety rules. Working smoke alarms are now mandatory on every floor of every home in the Netherlands. The landlord is responsible for installing them, and the tenant is responsible for their basic upkeep (e.g., changing batteries). Together, clear escape routes and functioning smoke alarms form the essential pillars of fire safety, providing the early warning and the clear path needed to prevent tragedies.
